We specialize in photographing children’s artwork and providing high-quality digital images of the artwork. Our services include:

• Photographing your child’s artwork
• Providing digital copies of the photographed artwork
• Offering print and product options for the artwork (optional)

By using our services, you affirm that:

• You are at least 18 years old or have the consent of a parent or guardian to use the Site.
• If submitting artwork for a child, you are the parent or legal guardian of the child whose artwork is being submitted.

If you are under 18, you may use the Site only with the involvement of a parent or guardian.

You may submit your child’s artwork to us by putting it in the art box that is provided free of charge. By submitting artwork, you agree that:

• You have full legal rights and ownership of the submitted artwork.
• You grant us permission to photograph and create digital images of the artwork.
• You acknowledge that the photographs will be created for the purpose of providing the agreed-upon services (e.g., digital image delivery, prints).

If you provide us with physical artwork, you are responsible for ensuring that all artwork you want photographed is included in the art box provided.

• The copyright of the original artwork remains with the child artist or the parent/guardian who submitted it.
• Upon photographing the artwork, we retain the rights to the digital images created, including the right to use those images for the purpose of fulfilling the service you requested (such as creating and delivering digital files or prints).
• You may not reproduce, distribute, or use the digital images for commercial purposes without our express written permission.

• We take privacy seriously. We will not disclose any personal information or the identity of the child artist without your consent. For more details, please see our Privacy Policy.
• We may ask for your permission to showcase the digital images of the artwork on our website, social media accounts, or other promotional materials. However, we will always obtain explicit consent before using any images publicly.
• You can request that any images of your child’s artwork be removed from our public gallery or other promotional materials at any time.

• You agree to pay the fees associated with our services as listed on the Site at the time of your order. Payments may include, but are not limited to, photographing, digital image creation, print orders, and shipping fees.
• All fees are due in full before we process your order. We accept payment via Venmo & PayPal.
• Prices and fees are subject to change, but any changes will be communicated to you before you make a new purchase.

• Upon completion of the photograph and processing, we will deliver the digital images to you via [email, secure download link, etc.].
• We will make reasonable efforts to ensure the timely delivery of the digital images. However, we are not responsible for delays due to circumstances beyond our control (e.g., internet issues, technical problems, etc.).

• Due to the nature of our services (customized photography and digital images), we do not offer returns or refunds once the images have been delivered. If there is an issue with the quality of the images, please contact us immediately, and we will work to resolve the issue to your satisfaction.

You agree to use the Site in a manner that is lawful and in accordance with these Terms. You may not use the Site:

• In any way that violates any applicable law or regulation.
• To upload, post, or transmit any harmful, offensive, or unlawful content, including but not limited to content that infringes on intellectual property rights, privacy, or the rights of others.
• To interfere with or disrupt the Site or servers.

To the fullest extent permitted by law, www.kidcreatives.art, its owners, affiliates, and employees are not liable for any indirect, incidental, special, or consequential damages arising out of your use of the Site or our services. This includes, but is not limited to, damages related to lost data, lost profits, or any other losses that may occur due to delays or technical issues.
